To ensure a safe, respectful, and productive environment on 2Famez.com, the following fundamental rules apply to all users:

1. Professional Conduct: Interactions must be respectful and professional; harassment and hate speech are not allowed.
2. Authenticity: Only genuine and authentic content is permitted; copyrighted materials may only be posted with permission.
3. Age Restriction: Access and content creation are only allowed for individuals above the legal minimum age.
4. Transparency in Advertising: Advertisements and promotions must be transparent and honest.
5. Privacy Protection: Sharing personal information of others without consent is prohibited.
6. Legal Compliance: Users must adhere to all relevant laws and regulations.
7. No Malware: Distributing viruses or malware is forbidden.
8. Content Guidelines: Content must comply with platform guidelines and be appropriately marked.
9. Constructive Use: The platform should be used constructively for growth and community.
10. Reporting and Moderation: Users are encouraged to report inappropriate content; the platform reserves the right to take action in case of violations.
11. SFW Content and Youth Protection: Only Safe-for-Work content that does not violate youth protection laws is allowed.

These rules are designed to foster a positive atmosphere where content creators can be free and creative while ensuring a safe space for all users.

Terms of Use for 2Famez

PREAMBLE

These Terms and Conditions govern the contractual relationship between you (hereinafter referred to as the "Member" or "you") and Famous Media d.o.o., Tolstojeva 41, 21000 Split (hereinafter referred to as the "Provider" or "2Famez"). Members can access, download, and store these terms at any time, even after the conclusion of the contract.

By using the services of the Provider and clicking the box "I have read and accepted the Terms of Use" (literally or in substance), members agree to be bound by these Terms of Use. Contrary terms of use by members do not become part of the contract.

The Provider reserves the right to adjust or change these Terms of Use. In the event of such adjustments or changes, the Provider will send them to you by email four weeks before they come into effect. If you do not object to the validity of the new Terms of Use within four weeks of receiving the email, they are considered accepted. In case of objection, the Provider has the right to terminate the contractual relationship. The email containing the modified terms will specifically highlight the significance of this four-week period.

1. GENERAL

2Famez is a social network community operated by Famous Media d.o.o., Tolstojeva 41, 21000 Split.

The 2Famez service is intended for natural, adult persons who can register for private and commercial purposes. Members have the opportunity to access profiles with photos, texts, videos, and other information from other members on 2Famez. They can also upload their own content such as texts, photos, videos, etc., and engage with other members.

Registration on 2Famez and the use of the community are free. Members have the option to sell their uploaded media for credits. The Provider also reserves the right to offer certain and specially marked services for a fee. Paid options will be clearly marked and can be activated by members themselves. Members (users) can purchase virtual currency, credits, on 2Famez. There is no return of credits against a refund of the amount paid.

The Provider expects a cultivated and respectful tone from every member in their interactions.

2. SERVICES OF THE PROVIDER

The Provider offers a portal on the internet through which members can upload content and information and access content provided by other members. The Provider enables the availability of this content. The contractual service of the Provider consists of granting access to its internet portal.

The Provider reserves the right to review, reject, correct, delete, and/or temporarily or permanently block a member's account before the publication of content and information, such as usernames or profile pictures, at its discretion. This is particularly the case when the Provider becomes aware of a violation of these Terms of Use or legal provisions, discovers false information, or other significant reasons exist. In such cases, any outstanding commission claims are forfeited.

The Provider reserves the right to verify the authenticity or correctness of member accounts and may request specific documents, such as verification images or copies of identification documents, from members. If members fail to comply with this request, the Provider reserves the right to delete the account.

Members have no entitlement to use the services of the Provider and/or the publication of content on the Provider's portal. In the event of violations of these Terms of Use, legal provisions, or other significant reasons, such as disrupting the harmonious interaction of members, the Provider may impose a virtual ban on members.

Members who have received a ban are prohibited from re-registering. If bans are circumvented through new registrations under a new pseudonym, the account data will be deleted. Legal action will be taken against former members with bans who attempt repeated re-registration (injunction).

In case of serious personal attacks, insults, defamation, threats, or other criminally relevant behavior by a member, the Provider reserves the right to involve law enforcement authorities. The assessment of a situation leading to a change, rejection, deletion, blocking, or the issuance of a virtual ban lies within the Provider's discretion.

Services, functions, and content of the platform may be changed, expanded, or restricted by the Provider at any time. In the case of paid options, the Provider will ensure fair compensation.

If a member's free account is not used for more than 3 months, the Provider may delete it without further notice. In this case, there is no claim to the storage or release of data.

3. CONTRACT CONCLUSION/TERMINATION

By registering on 2Famez, you submit an offer to conclude a usage agreement with the Provider. The required information for registration includes the username, email address, and password. You can also register through third-party connect functions (e.g., Facebook Connect). In this case, selected data from your profile is transferred to the Provider's database. By registering through connect functions, you agree to the respective conditions of third-party providers and consent to certain data being transferred to the Provider's database.

Only one account per person is permitted. There is no entitlement to conclude a contract.

After registration, you will receive an email from the Provider confirming your registration. The contract is concluded when you receive this confirmation.

Members can terminate the contractual relationship at any time by sending an email to info@2famez.com or by deleting their account in the account settings. The Provider can terminate the contractual relationship at any time with a notice period of two weeks. The right to an extraordinary termination for cause remains unaffected.

After termination of the contractual relationship, members have no claim to the restoration or provision of data, credits, or other content uploaded to the portal.

4. OBLIGATIONS OF MEMBERS

Members are solely responsible for the content, information, texts, photos, videos, etc., that they upload, publish, or otherwise make publicly accessible on 2Famez. The Provider does not check content for completeness, accuracy, legality, timeliness, quality, or fitness for a particular purpose.

Members ensure that the content and information they provide do not violate statutory provisions, morality, or the rights of third parties (e.g., copyright, trademark, personality rights).

Members may only upload photos for which they have the necessary rights (e.g., copyright, personal rights). The same applies to other content and information.

Members are prohibited from using 2Famez for commercial purposes without the prior written consent of the Provider. This includes, in particular, the dissemination of advertising or other commercial content.

Members are prohibited from disseminating content or information that glorifies violence, incites violence, is sexually explicit, contains pornographic content, or is otherwise offensive or illegal.

Members are obliged to keep their access data confidential and to protect it from access by third parties. The Provider must be informed immediately if there is reason to suspect unauthorized use of the access data. Members are liable for any damage caused by unauthorized use of their access data unless they are not responsible for the misuse.

Members may not use software or other mechanisms that may interfere with the functionality of the 2Famez platform.

The Provider reserves the right to verify compliance with these obligations at any time and to take appropriate measures, including but not limited to the deletion or blocking of content, warnings, and the issuance of virtual bans.

5. RIGHTS OF USE

By uploading content (e.g., photos, texts, videos), members grant the Provider the non-exclusive, transferable, sublicensable, free-of-charge, and worldwide right to use, reproduce, distribute, publicly display, and publicly perform the content in connection with the operation of the 2Famez platform.

The Provider is entitled to edit, shorten, or otherwise modify the content as necessary for the purposes of publication on 2Famez.

Members have the right to delete their uploaded content at any time. The rights granted to the Provider expire with the deletion of the content.

The Provider is not obliged to use the uploaded content or make it publicly accessible. The Provider may remove or block content at its discretion, particularly if it violates these Terms of Use or legal provisions.

6. LIABILITY

The Provider is only liable for damages that result from intentional or grossly negligent conduct. The Provider is not liable for the accuracy, completeness, legality, timeliness, quality, or fitness for a particular purpose of the content provided by members.

The Provider is not responsible for the behavior of members or third parties on 2Famez.

The Provider is not liable for technical malfunctions, in particular, the constant and uninterrupted availability of its services, as far as this is not possible for the Provider despite reasonable efforts. The Provider endeavors to keep 2Famez available to the greatest extent possible. Temporary limitations or interruptions of availability may occur due to maintenance work, security reasons, or other technical reasons.

The Provider is not liable for damages caused by the loss or misuse of access data due to the fault of members.

7. FINAL PROVISIONS

The law of the Republic of Croatia applies exclusively to the exclusion of the UN Sales Convention. If you are a consumer and have your habitual residence in the European Union, you can also rely on the mandatory provisions of the law of your country of residence.

If you are a merchant, a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from or in connection with contracts between you and the Provider is the Provider's registered office.

Should individual provisions of these Terms of Use be or become invalid or unenforceable, the validity of the remaining provisions remains unaffected. The invalid or unenforceable provision shall be replaced by a valid and enforceable provision that comes as close as possible to the economic purpose pursued by the invalid or unenforceable provision. The same applies to any gaps in the contract.

These Terms of Use are also available in German. In the event of discrepancies or contradictions between the English version and the German version, the German version shall prevail.
